Defense: Phillip Garrido hears "angels' voices"

(CNN) -- Phillip Garrido, a California sex offender suspected of abducting Jaycee Dugard in 1991 and keeping her captive for 18 years is suffering from "serious mental illness," defense attorneys say in court papers. "It appears that Phillip Garrido has been hearing [the] voices of angels for years," said documents filed Wednesday in El Dorado County Superior Court.

The court papers dispute prosecutors' asserting that Garrido is a "master manipulator" who is still trying to influence his victim...

Garrido, 58, and his wife, Nancy, are charged with 29 felony counts in the kidnapping...

Both Phillip Garrido, who was a registered sex offender on parole at the time of his arrest in August, and Nancy Garrido have pleaded not guilty to the charges against them...

SACRAMENTO, Calif. (AP) -- Phillip Garrido has contacted a Sacramento television station to express concerns about the legal rights of the woman he is charged with kidnapping 18 years ago, raping and hiding in the backyard of his home.

In a letter addressed to a KCRA anchorman and dated Sept. 29, Garrido wrote that Jaycee Dugard "has been repeatedly denied access to have an attorney present during questioning," the station reported Wednesday.

"Over and over she clearly expressed this request from the beginning to the conclusion of questioning," Garrido wrote. "Her civil rights have been clearly violated."...

Dugard's stepfather, Carl Probyn, told KCRA that the letter "sounds stupid."
"He violated her rights. We've got her back," Probyn said.

[Garrido's] lawyer, public defender Susan Gellman, said she had counseled her client not to speak with the news media and that she would strongly reiterate that advice.

Calif. police search home next to couple charged in kidnapping; seek links to other crimes

ANTIOCH, Calif. (AP) — Armed with rakes, shovels and chain saws, about 20 officers on Sunday combed the backyard of a couple charged with kidnapping and raping Jaycee Lee Dugard and used cadaver dogs to search an adjoining property where neighbors say one of the suspects once served as a caretaker.

Sheriff's deputies and prosecutors from two counties and officers from two city police departments were using the dogs, shovels and other tools to inspect the neighboring yard, which sits behind an off-white house with a chain link fence."We do consider it a crime scene," said Jimmy Lee, a spokesman for the Contra Costa County Sheriff's Department...

[In 2006 a neighbors] then-girlfriend called police after she saw tents and children in the backyard, but the responding deputy did not uncover the backyard compound.

...Police in Pittsburg, a Bay Area city near where the Garridos lived, have said they are investigating whether Phillip Garrido may be linked to several unsolved murders of prostitutes in the 1990s...

...Karen Walker, 58, who has lived two doors down for the last five months, said the Garridos had a fire recently in a van parked on their property. When neighbors went to investigate, Phillip Garrido "shooed people away," Walker said. She could not recall ever seeing Jaycee Dugard, but remembered seeing two shy young blonde girls.

Walker said her 9-year-old grandson once asked the younger of the two girls if she wanted to play."They asked if they could ride bikes with her, just being friendly, but she said she couldn't," she recalled.

Other neighbors said they pointedly kept their distance from a man they nicknamed "Creepy Phil," partly because he ranted about hearing voices from God, and because some knew that he was a registered sex offender. But they assumed parole authorities were keeping a close watch on their neighbor who was convicted three decades ago of abducting and raping a casino worker in a Nevada warehouse that a former detective described as a "sex palace" for playing out his fantasies...

...Her stepfather says her two children remain with her and she is healthy although she feels guilty about developing a bond with Garrido. "Jaycee has strong feelings with this guy. She really feels it's almost like a marriage," said Carl Probyn, who had witnessed the kidnapping and tried to give chase.

Phillip and Nancy Garrido pleaded not guilty Friday to a total of 29 counts, including forcible abduction, rape and false imprisonment.

...Garrido and his wife, 55-year-old Nancy Garrido, were booked into the Contra Costa County jail in Martinez late Wednesday night, according to jail records.

Phillip Garrido was booked on charges including kidnapping, conspiracy, rape and committing lewd acts with a minor, according to the records. Nancy Garrido is accused of kidnapping and conspiracy. Both are being held in lieu of $1 million bail.
Phillip Garrido has a business called God's Desire, based out of his home in Antioch. He referred to God's Desire as a church in a telephone interview.

"What's kept me busy the last several years is I've completely turned my life around," Garrido told KCRA 3... People who knew Garrido said he became increasingly fanatic about his religious beliefs in recent years, sometimes breaking out into song and claiming that God spoke to him through a box.

Dugard's stepfather, Carl Probyn, who now lives in Southern California, said Thursday that Dugard's mother, Terry Probyn, called him Wednesday afternoon and told him the FBI had contacted her to say they may have found her daughter...

...The mother and daughter met Thursday morning at an area hotel. Dugard retains custody of her children, authorities said. A DNA test is being conducted to confirm her identity...tears of joy that Jaycee was alive became tears of horror and anger when details of her abduction and long captivity were recounted by police.

The man who allegedly abducted American schoolgirl Jaycee Lee Dugard almost two decades ago has admitted that he did a "disgusting thing" but went on to defend himself, saying the public would be surprised by the "heart-warming story".

Convicted sex offender Phillip Garrido, 58, is being held on suspicion of various kidnapping and sex charges relating to the disappearance of Miss Dugard, who was aged 11 when she was snatched from her school bus stop in 1991.

Mr Garrido, gave a bizarre and sometimes incoherent phone interview to KCRA-TV from the El Dorado County jail.

According to investigators Mr Garrido allegedly raped Miss Dugard and fathered two children with her, the first when she was about 14. Along with Miss Dugard, who is now 29, the children, both girls now 11 and 15, were also kept hidden away from the world in the backyard compound of the Garrido house in California.

In the interview, Mr Garrido said he had not admitted to the kidnapping and that he had turned his life around since the birth of his first daughter 15 years ago. "Wait until you hear the story of what took place at this house," Mr Garrido said.

"You are going to be completely impressed. It's a disgusting thing that took place with me at the beginning. But I turned my life completely around and to be able to understand that, you have to start there.

"You're going to find the most powerful story coming from the witness, the victim - you wait. If you take this a step at a time, you're going to fall over backwards and in the end, you're going to find the most powerful heart-warming story."

His wife, Nancy Garrido, 54, has also been arrested, and authorities have alleged she was with Mr Garrido, who is on lifetime parole, during the kidnapping in South Lake Tahoe.

Miss Dugard, now aged 29, was reunited with her mother on Thursday after revealing during an interview with her kidnapper's parole officer that she was the victim of one of California's oldest unsolved crimes. It was her first known appearance in public since her abduction.

She disappeared when a man and a woman pulled her kicking and screaming into a car at a school bus stop just yards from her home in South Lake Tahoe...

A police press conference revealed that Jaycee Lee Dugard has been living in a series of sheds and tents in a hidden backyard at the home of her alleged kidnapper Phillip Garrido, below.

Police also say that Garrido allegedly fathered two children with Dugard. The children are 15 and 11, meaning Dugard was just 14 when she had the oldest.

According to police, authorities were tipped off to Dugard's plight when Garrido was questioned by campus security at UC Berkeley when he tried to hand out pamphlets.
This led to a meeting with Garrido's parole officer where the officer met Dugard and the two children. The parole officer informed local police about the children...

In 1991, Jayce Lee Dugard, then 11, was forced into a car outside of her California home by an unidentified man and woman. Today, 18 years after her disappearance, a woman claiming to be Dugard turned herself into a San Francisco Bay Area police station.

The woman came into a San Francisco Bay area police station and said she was Jaycee Lee Dugard, a blond, ponytailed girl when she was abducted as she headed to a school bus stop 18 years ago, said sheriff's Lt. Les Lovell of the El Dorado Sheriff's Department.

"We're 99 percent sure it's her," Lovell said. He said DNA tests were being conducted. The woman was in good health. It was not immediately clear when she had surfaced at the station.
Lovell said Concord police did an investigation after the woman surfaced, and he received a call Wednesday from investigators who had tentatively identified her as Dugard.

Her family has been contacted and they are in the process of arranging a meeting, said Lovell, who was a detective assigned to help investigate the kidnapping in 1991. "We are very confident at this point in time that it is her."

Two people have also been arrested in relation to Duggard's disappearance.

Jimmy Lee, a spokesman for the Contra Costa County Sheriff's Department, confirmed that a man and a woman have been arrested in connection with the case but could provide no other details. CNN affiliates have reported that Phillip Garrido, 58, and his wife, Nancy Garrido, have been charged.

Phillip Garrido is a registered sex offender and listed on the Department of Justice's Megan's Law page because of a previous forcible rape charge.

The Bee also has more details on Garrido, one of the suspects in the case:
Garrido's next-door neighbor said people in the area had known for years that Garrido was a registered sex offender and that at one point someone called authorities because they were concerned that there were children living in the home.
Haydee Perry, 32, said her boyfriend has a 7-year-old daughter and that he was concerned about Garrido living next door. She said a friend of her boyfriend had called police a few years ago because there were children living in the Garrido home and other people were living in the yard in tents. Neighbors also noted that Garrido had a penchant for wandering the neighborhood distributing religious tracts and quoting Bible verse, she said. Perry added that nothing came of the call to police.

LOS ANGELES - A California girl snatched by kidnappers almost two decades ago miraculously has been found alive, cops said today...The woman believed to be Dugard is now 29.

Philllip, 58, and Nancy Garrido, 54, of Concord, Calif., have been charged with kidnapping to commit rape. They are behind bars on $1 million bail, court records said...Phillip Garrido is a convicted sex offender...

Elated mom Terry Probyn was en route from her Southern California home to meet with her daughter after speaking with her briefly on the phone. "Jaycee remembers everything," Carl Probyn, her stepfather, told CNN. "They talked back and forth and she had the right answers to all my wife's questions."
