HUNTSVILLE -- A Dallas man was executed Thursday evening for the rape-slaying of a woman abducted while she was trying to make a call at a pay phone 10 years ago.

Derrick Lamone Johnson's mother became emotional as she entered the witness chamber and saw her son strapped to the gurney. In a matter-of-fact voice, Johnson told her, "Don't cry. It's my situation. I got it. Hold tight. It's going to shine on the golden child." After telling her he loved her, Johnson said, "That concludes the statement."

The victim's father and two sisters also were among witnesses. Johnson did not acknowledge them.

Nine minutes after the lethal drugs began to flow, he was pronounced dead at 6:23 p.m.
Johnson, 28, was the 14th Texas prisoner executed this year in the nation's most active death penalty state.

LaTausha Curry, 25, of Dallas, was robbed of less than $10, was driven away in her car, raped, beaten with a two-by-four and suffocated with her own blouse. Authorities determined the 1999 slaying was part of a two-week crime spree involving Johnson and a companion that left numerous women robbed or raped from Dallas to south of Waco, some 100 miles away.

Lawyers for Johnson went to the U.S. Supreme Court to block the punishment, contending Johnson was mentally disabled and ineligible for execution under high court guidelines. About an hour before Johnson could be taken to the death chamber, the high court turned down his request for a reprieve and a review of his case.

In their appeals, attorneys argued Johnson's sentence should be commuted to life, that he was the product of a difficult childhood where both his parents were imprisoned for drug convictions, that he was beaten by relatives who raised him, that he had a history of school suspensions and expulsions beginning with the sixth grade and that IQ testing put him within the range of what the courts have defined as mental retardation.

The 5th U.S. Circuit Court of Appeals rejected the argument earlier Thursday, a day after the Texas Court of Criminal Appeals turned Johnson down.

Greg Davis, a former Dallas County assistant district attorney who prosecuted Johnson for capital murder, said he remembered the grief of Curry's mother, who died not long after the trial. "I remember her mother coming in and saying how she lost more than a daughter," Davis said. "She said, 'I lost my best friend.' It did break the mother's heart. I think this case ultimately killed her as well."

Several women who survived attacks from Johnson and a partner, Marcus Maxwell, then 15, testified at Johnson's trial.

Maxwell, who was set to be tried as an adult, took a plea deal and is serving 40 years in prison.
Johnson declined an interview request from The Associated Press but said he was wrongly convicted and complained about his court-appointed defense attorneys on a Web site devoted to death row inmates.

"That's a real shock," Wayne Huff, one of Johnson's trial lawyers, said sarcastically. "The system is corrupt and there is no 'Justice' if you are of the low class," Johnson wrote. "It is sad that if you are a poor man in the system there is no justice for you."

In a confession to police, Johnson said he and Maxwell raped and killed Curry, who worked as a security guard and had a 4-year-old child. He told officers where to find her body in an overgrown part of a park in Dallas' Oak Cliff area. His fingerprints were in her car and DNA tied him to her rape.

After they killed Curry, records show the pair robbed a woman at a gas station. Later, driving Curry's car, they rammed into another woman's car in a carjacking attempt. That woman called police but Johnson and Maxwell ran off.

Johnson was arrested four days later at his mother's apartment, Police found bags of cocaine inside a hollowed-out pager he was carrying.

His mother was the only defense witness at his capital murder trial. She testified he'd been raised by family members after she was sent to prison with a 15-year drug sentence.

Records showed Johnson was arrested two years earlier for robbery, pleaded guilty and received 10 years probation that included a stint in a boot camp. He was released from the camp after 65 days for good behavior.

Johnson was among at least six Texas inmates with execution dates extending into the summer. Scheduled to die next, on May 19, was Michael Lynn Riley, 50, condemned for the slaying of Winona Harris. The victim was stabbed more than 23 years ago during the robbery of a convenience store in Quitman, about 80 miles east of Dallas.

Johnson would be the 198th Texas inmate put to death since Rick Perry became governor when George W. Bush resigned following his presidential election in 2000.

Capital punishment opponents from Amnesty International USA and the Texas Coalition to Abolish the Death Penalty planned to gather for a 200-minute vigil outside the criminal courthouse in Houston Thursday to mark what soon will be the 200th execution of Perry's tenure. During Bush's six years as governor, 157 executions were carried out in Texas.

Casey Anthony Case: Baez's New Defense Strategy: "Ugly Coping"
Many legal experts say the toughest part of defending Casey Anthony will be explaining her behavior after her 2-year-old daughter, Caylee, disappeared when she goes on trial for life.
They are images of Casey Anthony partying just days after her two year old daughter Caylee went missing.
In surveillance videos, Casey is seen buying beer and bras with money, investigators say, she stole-- from one of her best friends.
How does Anthony explain her lack of concern, grief or remorse?
"She has a very compelling reason for her actions," her attorney Jose Baez said in an exclusive interview with WESH 2 reporter Bob Kealing.
Baez declined to be more specific.
"As much as I'd like to say it, that's as much as I can say right now," Baez said.

Baez, however, did refer to a case that could provide insight into his defense.
In 2002, Cynthia Sommer lost her husband, Todd, a healthy Marine stationed in San Diego.
Sommer's attorney Allen Bloom said Todd Sommer was “originally evaluated to have died by natural causes, a sudden cardiac arrest from an arrhythmia of the heart.”
Two months after her husband died, friends told investigators Sommer bought breast implants with the insurance money, started partying and sleeping around.
Cynthia Sommer was charged with murder. Her attorney argued that Sommer's apparent lack of remorse was a condition known as "ugly coping." The phrase was coined by a Columbia University behaviorist to describe people who appear to grieve abnormally.
According to Cynthia Sommer's attorney, prosecutors were willing to overlook problems with their evidence, because they mistook her so-called ugly coping as evidence she had no remorse and was guilty of murder.
Sommer's attorney finally proved her husband's death was not motivated by her greed. After two years Cynthia Sommer walked out of prison.
How do you explain then, Casey's same exact behavior "months before" Caylee went missing. Seems Casey had enough of mommy-hood, and wanted to party like a rock star. I don't buy this "ugly coping" defense. Casey should have been coping with her ugliness long before Caylee went missing. ~And I am not referring to looks, either.
So this "ugly coping" defense, that caused Casey to buy beer and bras--was during the time that "the nanny" had Caylee, and was going to return her on her birthday--according to Casey. Correct? So why would Casey be "grieving" or coping with anything?
According to Casey, Caylee was not "missing", "lost", or even "dead", she was "with the nanny". According to Casey.
But we all now know the truth, Caylee was bagged up and tossed away like trash while Casey was boozing and whoring it up -- living la "Bella Vita" as Casey's tattoo described.
Remember, the one she got right after Caylee's murder.
Wonder if Casey's Marine, Mark Hawkins, knew of the Todd Sommer case?

Update: Possible Sighting of Missing NY Teen, Brittanee Drexel in Myrtle Beach
Possible Sighting of Missing Teen Reported Wednesday Morning
Myrtle Beach police are conducting an intensive search of the Ocean Boulevard area near the Bar Harbor Hotel after a report Wednesday morning that Brittanee Drexel, the Rochester, NY teen--missing on spring break,--was seen on a transit bus.
Capt. David Knipes says a girl fitting Drexel's description got off the transit bus, which carries hospitality workers from Williamsburg and Georgetown counties to Myrtle Beach, around 8:30 Wednesday morning.
Witnesses said the girl was wearing light blue jeans, Crocs, a pink hoodie with Myrtle Beach on the left front area, and a dark blue shirt underneath. They said she had brown hair with blonde highlights and looked "clean and showered."
Witnesses told police she got off the bus and headed south.
Police are going through beach accesses in the area and visiting businesses to pass out fliers with Drexel's picture. Police in cars, on motorycles, on bicycles and on foot are involved in the search.
Cpt. Knipes says detectives are interviewing people on the bus and have contacted the bus company to find out where it stopped this morning on the way to Myrtle Beach.
Brittanee's mother is also holding out hope, though she still fears the worst.
"The worst thoughts are either somebody took her, somebody may be holding her against her will or she may not be alive, " Dawn said.
Calls to Peter Broswick, the last known person to have seen Brittanee, went unreturned on Tuesday, though it is being reported that Broswick has hired an attorney and isn't talking.
Myrtle Beach Police say they're working with SLED and other agencies on several leads, but they aren't speculating. The Georgetown County Sheriff's Department assisted Myrtle Beach in investigating one lead on Tuesday, though they wouldn't elaborate.
Cpt. David Knipes with Myrtle Beach Police Department couldn't answer many specifics on Tuesday but said they aren't ruling anything out.
"Until you actually have a person and know they're OK, you can't rule anything out. You know, it could be anything from being a runaway to an abduction. We just don't know right now," said Knipes.
Knipes said several investigators are tracking down all leads including reviewing cell phone records and surveillance video and tracking down interviews.
When asked what he thought of Broswick's leaving just hours after last seeing Brittanee, Knipes said he's sure eyebrows would be raised.
"I have not had the chance to interview him to find out why. Obviously going back to Rochester is a 16-17-hour drive. I don't know what his plans were. So it's hard to speculate without talking to him directly," Knipes said.

The name of this episode is "Selfish", fitting title.
Except for the first fifteen minutes of the show, the similarities between this episode and the case against Casey, are few and far between. It was just another ratings ploy, which is always the case with these tv shows taunting the "ripped from the headlines" angle. However, the use of Cindy's Anthony's "It smells like there's been a dead body in the damn car" came into play, as well as a few other of her tirades. There is a scence in which the "grandmother", played by Gail O'Grady, says she "cracked" her daughter's mouth, when she found out she had stolen her credit card. Mother and daughter go a few rounds, pretty tame to what probably went on between Cindy and Casey during their "presumed" throwdowns. Then we have a scene of the "grandmother" telling the "grandfather" something to the effect that he needs to grow a pair of balls. Well, at least they had Cindy's persona down to a science.
With all the hype of the parallels to the Anthony case, this episode was hard to watch without wanting to compare the two. The similarities thankfully, appeared to subside when the toddler's cause of death was revealed.
The ending of this episode took a turn that involved the grandfather of "Sierra", the toddler. I found the ending to be a definite slap in the face to George Anthony and to those who have experienced this trauma in their personal lives. Seriously, the episode could have gone a different way.
I have always admired Gail O'Grady's work as an actress. However, she needs to stick to Lifetime movies and leave her "portrayal" of Cindy Anthony behind her...for her sake. The "big haired mother" of a white trash/party girl/teen mother, is not one of her best roles.
I did not find Hilary Duff's performance to be believable, or honestly, that great. The former "tween princess" need not stoop as low as a mock up of Casey Anthony to escape her Lizzie McGuire days.
A big fan of Annie Potts, I felt she was short on scenes, and was surprised that she did not take on a more "Baez-like" character. I would call it more "Gloria Allred". Although, Potts did come across as the defense attorney with more dignity and character than Baez himself.
Not wanting to spoil the episode for those who have not had the opportunity to view it yet--I will say this, I do not see this episode of Law and Order: SVU having any impact on the potential jury pool.
As much as I was intrigued by the "cause of death" issue, as well as the relevance of "the cause" and the need for further regulation, this episode did nothing but make a mockery out of the real crime itself.
The real crime being that of a beautiful two year old named Caylee, and her life taken away by the hands of her mother, named Casey, who was and is still, indeed, "selfish".

“I didn’t think so for a long time, based on statistics for these kinds of missing children cases,” Captain Dominic Piscatello, chief of major crimes for the Putnam County Sheriff’s Department, told me Monday. “But now, based on what we’ve learned, I’m holding out hope..."
According to her family, Misty just retained an attorney, like her husband. In an exclusive interview several weeks ago, she told me she didn’t need one “because only guilty people need a lawyer.”
...[Christina] Prevatt aka Nay Nay was back in the Putnam County Jail Tuesday...she was rebooked after William Staubs, aka “Cobra,” pro bono private eye and bounty hunter, tracked her to a “filthy” Palatka crash pad, and announced he was revoking her $2,400 bond on drug charges. He’d bailed her out last week...then learned she’d allegedly tried to snatch her own child, a nine month old girl named Destiny, from the father, Donovan Spells, 47.
Captain Piscatello hopes to harvest clues from all the emotional chaos, and within minutes of her booking, had investigators grilling her again about what she knew about Haleigh’s disappearance or anyone who might know...“all we need is a break.”

I've tried not to be a bitch about the cast of characters and the town and all, but SHEESH!
What is wrong with these people? It appears the men are all thugs, the women accept being 2nd class citizens, and they seem to have a intricate genealogical web, where women have babies with a baby daddy, and the daddies and grandparents have custody of the babies. I am surprised Misty has two brothers who are married. Marriage doesn't seem to hold much stock in this generation in Putnam County, Florida.

There is a LOT wrong here, and no one wants to stand up and say it. Ron Cummings and the little missus and their respective families are WAY messed up. It is not just being backwoodsy and ignorant. Ron is an abuser, a bully, a control freak and a drug dealer who gets away with it by informing to the Sheriff's Office, and is more than likely aided and abetted by his mother, the police dispatcher. Misty is an immature, uneducated drug addict who is so stupid she thinks Ron Cummings is good husband material. They both seem to like to whore around and are both street smart with just enough intelligence to be manipulative. Both are bad liars.
Roy Kronk--Taxpayers Pay for Increased Salary and Additional Defense Monies
Orange County commissioners Tuesday morning approved spending more money for a lawyer to continue representing former meter reader Roy Kronk.
Kronk's attorney, David Evans, revealed that the county approved spending up to $2,500.
That's in addition to $10,000 that Evans has already billed the county for representing the man who discovered Caylee Anthony's remains in December.
Evans also adds the county wants him to represent Kronk during an upcoming legal deposition.

After discovering Caylee's remains, Kronk took a higher-paying job with the county.
Due to the notoriety he received after the discovery, Kronk was concerned for his safety if he was to return to walking area neighborhoods reading meters.
Wasn't Kronk driving a county vehicle during "all" the times he suspected he had found Caylee's remains? I do not recall him "being on foot" during one of the early 911 phone calls--he even described the truck to the 911 dispatcher that he was in so that the responding officer could identify him. ~my two cents

The mother of a missing New York state high school student has hit the streets with friends and family to find out any information that could lead to the safe return of her daughter.
Brittanee Marie Drexel, 17, of Rochester, NY was last seen around 8 p.m. Saturday.

Brittanee's mother and family went to businesses along the Boulevard looking for anyone who might have seen Brittanee Drexel inside their businesses.
The group received several leads and are working with Myrtle Beach Police Department detectives in trying to track her down.
One of those leads came from wait staff at the Oceanfront Bar and Grill, who said she was there on Sunday about 3 p.m., which would be the last known sighting of the teen.
Police are also looking for surveillance video to try to piece together where she went Saturday night.
Dawn Drexel says Brittanee is a junior at Gates Chili High School in Rochester, and was in Myrtle Beach with a group of older friends. Dawn Drexel says her daughter did not have her permission to travel to Myrtle Beach.
“I last talked to her Saturday around two o’clock. Her boyfriend spoke to her around eight o’clock,“ Drexel said.
“She sent a text message to one of her friends around 9:15 p.m. and said she was going to see another friend who was staying at another hotel. She never came back,“ Drexel said. “It’s been almost 48 hours, and I’m really worried. We need everyone to be looking out for her.“
John Hahn a friend of Drexel’s family and a Marine stationed at Camp LeJeune, NC, contacted police on the family’s behalf to report her missing. Hanh drove down to Myrtle Beach to help Dawn Drexel and her parents look for the missing teen.
“I’ve been friends with Britannee for a really really long time, we are very close friends. I’m trying to pray for the best but prepare for the worst,“ said Hahn.
Hahn and Drexel both tell News 13 that it is very unlike Brittanee to not keep in contact with family or friends. Drexel added that she has a bad feeling about what may have happened to her daughter.
“It’s horrible because all I can think about is that someone could’ve taken her, someone could’ve taken her out of state she could be laying dead somewhere. She is my first born and it’s just tearing me up inside, I’m just very very upset,“ said Drexel.
“I know for a fact that she wouldn’t just pack up and leave, leaving all of her belongings behind and not calling anybody,“ said Hahn.
According to the report, Drexel was staying with a group of friends at the Bar Harbor Hotel, 1010 N. Ocean Blvd. Since her disappearance, the group moved to the Boardwalk Hotel, located at 2301 N. Ocean Blvd.
Authorities handed out printed flyers of Brittanee’s picture to the beach’s watch patrol. Crews there said they are pretty heavily staffed at this time of the year, which makes it easy to do a search of any missing persons.
“With the water being as cold as it is and temperatures dropping at night it’s you know it’s very unlikely that she went for a swim or anything of that nature. We haven’t had any leads or any luck, we’ve been going up to different patrons doing pretty much everything that we can do out here to make sure she is not out on the beach or if she is we would definitely have found her by now,“said beach manager Wesley Cox.
“With the water being as cold as it is and temperatures dropping at night, it’s very unlikely that she went for a swim or anything of that nature.
Drexel is described as 5-feet tall, weighing 103 pounds. She has brown, shoulder-length, straight hair and blue eyes. She was last seen wearing a multi-colored striped shirt, black shorts, and flip-flop sandals. She reportedly suffers from depression.
Police entered Drexel’s description into the National Crime Information Center database on Sunday.

Cantu autopsy to remain sealed to avoid 'outrage'

STOCKTON — Results of autopsy and toxicology reports on slain 8-year-old Sandra Cantu could so infuriate the public that a judge asked them to remain sealed.
To release the reports would risk “a danger of public outrage” and threaten the Cantu family’s privacy, said San Joaquin County Superior Court Judge Linda Lofthus at an arraignment today for suspected murder-rapist 28-year-old Melissa Chantel Huckaby.
Huckaby entered no plea.“There is no doubt that the public considers the rape and murder of a child a heinous crime,” said Lofthus, who issued a gag order Tuesday. To seal all the documents related to the case will ensure a fair trial for both sides, she continued.
The defense dropped its request to exhume the little girl’s body.
Prosecutor Thomas Testa said both sides need about a month to review findings, which includes nearly 500 pages of written evidence and some audio recordings, he said. Lofthus ordered Huckaby back in court at 1 p.m. May 22 in Dept. 14 for further arraignment.
Huckaby’s demeanor in court today came as a stark contrast to her near-emotional breakdown at her first arraignment earlier this month. She smiled a few times at her public defender, Sam Behar. She stared calmly at the judge and at the dozens of reporters and the bailiffs who surrounded her during the brief hearing. She wore her hair down.
She sat calmly before the packed courtroom; her family sat behind her in the audience — father, Brian Lawless; grandmother, Connie Lawless; and aunt, Joni Hughes. Sandra’s family sat on the opposite side of the room. The girl’s uncle and aunt, Joe and Angie Chavez, sat with Sandra’s grandparents, José and Dolores Chavez. Susan Levy joined them. Sandra’s father, Daniel Cantu, and her mother, Maria Chavez, were absent.
Reporters crowded the courtroom. The judge banned all cameras and audio recorders, so photographers waited outside. The media attention has been overwhelming for everyone involved, the judge said. “This is the kind of case that we’ve never experienced in San Joaquin County,” Lofthus said.
Police arrested Huckaby on April 10, four days after they found Sandra’s body inside a waterproof suitcase. The girl went missing on March 27. Huckaby was booked at San Joaquin County Jail without bail on charges that she kidnapped Sandra, raped her with some object and killed her.
As charged, the single mother of a 5-year-old girl now faces the death penalty or life without possibility of parole if convicted.

New motion in Anthony case re Cindy Anthony
In the motion, the lawyers are asking a judge to press Casey’s mother, Cindy Anthony, to answer additional questions as a follow up to a deposition conducted earlier this month.
They are primarily interested in learning weather or not Casey ever used Cindy’s credit cards without her permission, a question Cindy refused to answer during an interview on April 9.
A judge will hear the issue on May 21.

Cindy Anthony vs. Oprah: Cindy Claims She Cancelled On Oprah
Video: Cindy Anthony Sends Text stating she, not Oprah, cancelled the interview, because of "integrity". heh... imagine Cindy Anthony and integrity in the same sentence.
The Oprah interview would have been the first exclusive interview with George and Cindy since the finding and identification of Caylee's remains in December, 2008.
Oprah Winfrey's camp released comment basically stating that Oprah indeed cancelled the interview. In part, due to the "exclusiveness" of the interview which was negated with the Anthony's recent sit down on CBS's The Early Show.
The interview between the Anthony's and Oprah was to be taped April 29 without a studio audience, and due to air in May, during sweeps week.

Is Ronald searching for Haleigh, trying to obtain custody of another child of his, ---how many children does this guy really have?-- or, is he just too busy partying it up with teen wife Misty and her circle of twenty something, and younger, party girls?
With a prior record of drugs, abuse, and weapons charges, Ronald may now be facing a custody battle over his son, "Junior" with his ex and Junior's mother, Crystal Sheffield.
The caller of the 911 call is Mary Brooks, the great-grandmother of "Jordan", Ronald's one year old son with Ms. Brooks' granddaughter, Amber, who happens to run in the same party circle as teen bride Misty Croslin Cummings, Ronald's wife.
In interviews, Ronald claims to have only two children, Haleigh and "Junior". Mary Brooks claims to have birth certificates that show Cummings as the father of Jordan, her great grandson.
Like Haleigh, Jordan also has a birth defect. Jordan was born with a genetic disorder called Microcephaly, where the head is smaller than normal from abnormal brain growth. It’s associated with Down’s syndrome, according to medical texts, and can be caused by a variety of factors, including, if during pregnancy the mother abused drugs or alcohol, was exposed to toxic chemicals or other diseases.

If Florida CPS is not involved after all of this, I do not know what would get them involved. Kudos to Art Harris and "Cobra" for all their hard work and for going above and beyond to get answers in the disappearance of Haleigh. Hopefully and prayerfully, it will be soon that this beautiful little girl will be found and those responsible will pay for their actions.

National Enquirer: Casey Anthony Had Accomplice
The latest edition of the National Enquirer, the May 4, 2009 issue, has Casey gracing the cover yet again. This time, their big lead and bombshell, "Casey had an accomplice and "he" is still on the loose."
I am wondering, how did the paparazzi know to be in Orlando at the time of Caylee's murder and the disposal of her body? Does the National Enquirer have paps hiding in the woods of every major city just waiting for a murder or other crime to occur so they can capture photos of the perp and / or an accomplice?
Also, how do they know the accomplice is a "he"?
Furthermore, why hasn't this "bombshell" revelation been brought to the attention of law enforcement? Must have been a slow news week.
Also, in the bottom inset of the cover, we see "The last photo of Caylee". Honestly, is there anyone out there that has not seen this photo?

Zenadia Gonzalez's attorneys file motions to force Cindy to answer questions Cindy thought were "not relevant" to the civil case against her daughter.
In the case against Casey Anthony, the law firm representing Zenaida Gonzalez in a defamation lawsuit against Casey wants a judge to force Cindy to answer questions and to pay for their costs.
Friday, the law firm filed a motion to compel Cindy Anthony to answer whether Casey ever used Cindy's credit cards without her permission.

Cindy refused to answer the question in the first deposition. Gonzalez is suing Casey, because she claimed a babysitter with the same name kidnapped Caylee.
Judge Rodriguez will hear the issue on May 21.
Jose Baez Interview: How Casey Anthony Could Go Free
Jose Baez, Casey Anthony's less than qualified defense attorney, is continuing the media whoring -the same attention of the media that he is so against when not so savory findings pertaining to his client Casey are released - to reveal key parts of his defense strategy of Casey.
Are you kidding me? This entire circus is out of control. But, what do you expect from an attorney who is not qualified for first chair, and perhaps, not even second chair of the death penalty murder trial he is "preparing".
Baez chastises the prosecution and law enforcement every time the cameras roll, yet at the same moment, he can't control his diarrhea of the mouth, which I believe he caught from Cindy.
Baez and other attorneys interviewed by WESH 2 said the woods where Caylee's remains were discovered are a central place in which much of the case could revolve.

Caylee was missing almost six months before her body was found. Baez said, "They don't know how Caylee passed away. They don't know when Caylee passed away."Baez and other defense attorneys say prosecutors have not definitively tied Casey Anthony to Caylee's remains along Suburban Drive. They have to prove that Casey dumped the body there before entering state custody and that they remained there for almost six months.
"That's going to become one of the major battlegrounds in the case," said defense attorney Richard Hornsby.
Thomas Luka, an attorney for Casey Anthony's brother, Lee, agreed: "That would be one of the first things I would want to pursue."
Baez also questioned the forensic evidence in the case.
He plans to vigorously attack the single hair found in Casey Anthony's car trunk that prosecutors say is proof a decomposing body was in there. He said his own expert Henry Lee found 17 hairs in the trunk that showed no signs of decomposition.
Baez also will raise questions about the air test that a lab said showed evidence of human decomposition.
"It's not science that's fully accepted within the scientific community," Baez said "It's science that's not been verified. There's absolutely nothing to gauge this science by, so, therefore, it should not be used when someones life is at stake.
After taking the death penalty off the table early on in the investigation, prosecutors now plan to seek the death penalty in the case.
A spokeswoman for State Attorney Lawson Lamar said, "We don't respond to anything about this case outside the courtroom."

The father of the underage victim told deputies he found his daughter in bed with Sprengeler Wednesday morning.
Investigators say the two had been having a relationship for several months. Sprengeler, according to investigators, is a "friend of the family".

Florida pharmacy says it wrongly prepped horse meds before match
An internal investigation by Franck's Pharmacy in Ocala, Florida, "concluded that the strength of an ingredient in the medication was incorrect. We will cooperate fully with the authorities as they continue their investigations," the company said in a statement issued Thursday afternoon.
"We extend our most sincere condolences to the horses' owners, the Lechuza Polo team and the members of the United States Polo Association. We share their grief and sadness," the pharmacy's chief operations officer, Jennifer Beckett, said in the statement.
The pharmacy said it prepared medication for the horses on orders from a veterinarian.
Liz Compton, a spokeswoman for the state Department of Agriculture and Consumer Services, told CNN that the agency is awaiting toxicology results from the animals and could not comment on the pharmacy's disclosure. "Obviously, we are going to follow any and every potential lead to get to the bottom of this," she said.
The horses were trained by Lechuza Polo, a Venezuela-based team. Its captain, Juan Martin Nero, told an Argentine newspaper earlier this week that he had "no doubts" vitamins administered to the animals were at fault.
"There were five horses that did not get the vitamin, and those were the only ones that survived," Nero said.
The horses collapsed one after another in front of spectators at the International Polo Club Palm Beach in Wellington, Florida, while being prepared for a tournament Sunday. Most were dead within an hour.

Also, during a jail visit three days after the voice mail message, Casey herself said that photo was actually taken at an ex-boyfriend's apartment.
Cindy was initially intrigued by the photo because of the "drum set" in the background because Caylee had become quite fond of playing the drums and spoke of it often, according to Cindy. Cindy also stated in early interviews that she and George were contemplating buying Caylee a drum set for her third birthday.

Melanie Ilene Rieger was a college student who was murdered by her boyfriend in 1994. The conference is intended to help the families of murder victims.
Cindy and George Anthony face constant criticism for choosing to support Casey. After telling investigators about Casey's lies, how she stole from the family and even from Caylee's piggy bank, the Anthony's are now dodging questions about whether they fault Casey for anything at all.
The Anthony's appeared on national television for the second day in a row Thursday to talk about their daughter Casey and how they are standing behind their daughter, despite the murder charges that she killed their granddaughter, and is now facing the death penalty.
When asked if they fault Casey for anything at all, Cindy responded, "How can we? We don't know what she's been through. I don't know what that girl has been through. George and I are living the same nightmare," Cindy said.
Focusing more attention on themselves, rather than on Caylee is another issue that victims' advocates in Central Florida claim they are outraged over.
"I wrote suicide notes back in July and August. No one knows that," said Cindy.
George says he wants to be a victim's advocate, helping the families of missing or murdered loved ones in Caylee's memory.
However, some advocates are offended by his actions because someone is already under arrest for Caylee's murder. Many of those victim advocates said they don't want his help. They say the Anthony's have damaged the progress made for victims' rights and for missing person's cases.
One advocate, in particular, is Claire Fielding.
Claire Fielding's daughter, Debra, was kidnapped, raped and murdered in April of 2000in downtown Orlando. She and others believe what brought about Caylee's death is very different and that George and Cindy Anthony knew that from the beginning.
George Anthony has stated, "I want to talk to more people about that kind of stuff. You can't give up. Even though the days get very hard for you, there are people to talk to besides your own family."
George Anthony showed up in Putnam County saying he was there to help Haleigh Cummings' family, even though, just days prior, he told a judge he was too depressed to face a court hearing at that time, as well as being deposed in the civil trial pending against his daughter, Casey.
"To me, this whole thing with the Anthony's, it's like a big circus and George and Cindy are the ringmasters," said Fielding.
Fielding is working with the Bereaved Survivors of Homicide in Orange County, a well-established group that quietly helps victims' families.
"If Casey didn't do it somebody did. Why are you not out there searching for that person instead of going on national television to publicizing whatever it is you want to publicize?" added Fielding.
She says she is disgusted with the Anthonys' network TV appearances and their overtures about helping others.

I have to agree, Anthony interviews have become too nauseous for morning TV.
I feel this memorial conference-- for the Anthony's-- was another ruse to gain sympathy and perhaps acquire some much needed insight on how true victims respond to and are affected by the heinous events that have taken away their loved ones.
George nor Cindy had no right, in my opinion, to even be in attendance at this Victims' Memorial. Yes, George and Cindy lost their granddaughter in a cruel and heinous act. As far as victims, they are victims of themselves~their actions, their words, their guilt, and their daughter, whom they both choose to "stand behind", (not "beside").
As tragic as Caylee's death is, it was done at the hands of her own mother.
I cannot accept the fact that George and Cindy "standing behind" Casey is out of an enormous outpouring of love for Casey. I think of the "choke out" that occurred between Cindy and Casey on June 15th. What type of love is that? Something horrific happened that night and the end result was Caylee's death. I will continue to believe that each Anthony member has Caylee's blood on their hands.
Who in the Anthony family is standing up for Caylee? Who in that family is driven enough to search for this so called "nanny" each and every day as Cindy proclaimed in the early days of Caylee's disappearance? Not one that I have seen. Maybe an offer of first class travel and accommodations would get them out looking for "Zanny". No, I believe they each know that all they have to do is visit OCSO to see Casey, and they will be looking the "nanny" directly in the face.
I am surprised we haven't heard of a reality show in the works revolving around the lives of George and Cindy and how they are dealing with their loss. Oops, better not give anyone any ideas.....

In the second part of the exclusive CBS interview, Cindy Anthony reveals she contemplated suicide in the wake of the disappearance of her two-year-old granddaughter, Caylee.

Cindy Anthony told Early Show co-anchor Maggie Rodriguez she had her brush with suicidal thoughts in late July, early August, soon after she reported to police that Caylee was missing.
"George and I are living the same nightmare," Cindy said to Rodriguez. " ... I can't judge George for certain things that he's done. You know? I understand certain things. I understand his suicide attempt. A lot of people don't know: I was there, too. I wrote suicide notes back in the end of July and August. No one knows that.
"(I wrote the notes) because I couldn't bear not having Caylee around and not knowing what happened to her. And I wanted, you know, you get to a point when you miss someone so much, that, you know, you think life's not worth living."
And what kept her from going through with it?
"Actually," Cindy responded, "Casey. Once Casey came home, the first time that Casey came home, the very first night, you know, being able to see her and hug her."
On July 15, Cindy called police. She's heard on the 911 call saying, "There's something wrong. I found my daughter's car today. And it smells like there's been a dead body in the damn car."
When Rodriguez asked if she regrets having made that call, Cindy responded, "No, I don't regret anything I did. How can I? I don't know how I would react any differently. I know, after I made the first 911 call, Casey thanked me in the car, because she said I did something that she couldn't do, (which) was to go to the police."
Both Cindy and George expressed what Rodriguez characterized as "unflinching" support for and faith in their daughter.
"I believe in her," Cindy insisted.
"There's some people," George pointed out, "who just say, 'Well, we should just be done with it, just ... be done with it. You can't. That's our daughter. You know?"
"No matter what she may or may not have done?" Rodriguez asked.
""No matter what, that's still our daughter," George answered. "That's - no - no matter what."

I find it rather, let's say, strategic, that Cindy is divulging this very personal matter regarding her attempted suicide. Cindy does not reveal any details other than she "wrote and left numerous notes". I do not feel the act of note writing justifies a suicide attempt. With Cindy's narcissism, this would have been a media bombshell and would have surely come up at some point during George's "attempt".
I am not one to take the matter of suicide lightly. It is a matter that has personally devastated my family. For Cindy to bring this "note writing" to light at this juncture, is nothing more than a self-centered act, purposely orchestrated to to gain sympathy from potential jury members, as well as the public in general.
These interviews, I feel, are going to further demonstrate Cindy as being self-absorbed and egotistic as well as portraying her manic depression. We have all witnessed her raging mania for all these months, and as recent as the depositions. Now, we have the soft spoken, suicidal Cindy, who did not reveal this much empathy at Caylee's memorial.
Honestly, I think Cindy doesn't want George to continue to have the spotlight on him as he is being treated with "kid gloves" in the media. So what better for Cindy to do - compile a sob story of her own - and, for a little added dramatic effect, praise her daughter for being the one that "saved" her from the brink.
The same daughter that is charged with murder of her own daughter and Cindy's granddaughter.
Hollywood couldn't have written a better script.

Police: Melissa Huckaby 'of interest' in Orange County CA arsons

LA PALMA - Police in Orange County say the woman charged with killing and raping an 8-year-old Tracy girl was questioned in connection with two arsons.
La Palma police Capt. Jim Enright said Wednesday that 28-year-old Melissa Huckaby was considered a person of interest in two fires set at a home where she lived in 2007.
Enright said a gag order issued Tuesday by a San Joaquin County judge handling the Sandra Cantu murder case prevented him from discussing Huckaby further. He said any investigation would halt while the murder case proceeded.
Authorities said the two fires caused nearly $90,000 in damages.
Huckaby remains in jail without bail facing allegations she kidnapped, raped and murdered her 5-year-old daughter's playmate. She is scheduled to appear in court Friday.
Charla Nash, Chimpanzee victim update

Nash, 55, lost her hands, nose, lips and eyelids on Feb. 16 when Travis, a 200-pound celebrity chimp belonging to Sandra Herold, of Stamford, attacked.
Matt Newman, an attorney for the conservator of Charla Nash, said Nash's right to privacy overrides the public's right to see the photos. The photos and records will be evidence in Nash's $50 million lawsuit against chimp owner Sandra Herold.
"They're extremely graphic, naturally," Newman said of the photos. "There is an overriding privacy concern with regard to the family members of Ms. Nash and in particularly her daughter."
Herold's attorneys did not object to the request to seal the photos and records, and Stamford Superior Court Judge Edward R. Karazin Jr. scheduled an April 27 hearing to discuss the request.
Karazin did not make an immediate ruling on Newman's request to make permanent a restraining order that places an attachment on Herold's property and assets, keeping her from selling them. Herold's attorneys are opposing the request because they say there was no way to predict the chimp would attack Nash.
Nash’s family filed a $50 million lawsuit in March, claiming Herold was negligent and reckless when she asked Nash to come over and lure her pet chimp back into her home.
Nash's attorneys are seeking an account of Herold's assets. A judge has granted a temporary restraining order that prevents Herold from selling or mortgaging her assets, and has scheduled a hearing for Monday on the attorneys' request for detailed financial information from Herold.
Herold's attorney said the attack was an accident and that Herold should not be held liable.
Stamford police are still considering criminal charges.

In an interview with the "Today Show" Tuesday, Nash's brothers said she is not interested in learning what happened to send her to the hospital.
“The psychiatrist said she understands a lot about her injuries but she’s not interested, at this time, to find out how they occurred,” Stephen Nash, said. Nash is being treated at the Cleveland Clinic, the first site in the United States to perform a face transplant, where she is in critical, but stable condition. She was moved there from Stamford hospital three days after the attack.
Nash’s family members are talking to doctors about reconstructive surgery and doctors said initial surgery would be focused on her facial injuries.
Since being attacked, Nash has made significant neurological and psychological improvement and is awake and able to communicate with her family and caregivers, doctors said.
“Since day one, the brain scans and the MRIs have turned out very positive and very encouraging,” Stephen Nash said.
Nash is able to sit in a chair, listen to country music, and tell her nurses if she is cold, tired or wants to be left alone.
She moves her arms and head to help nurses when they change her bandages and may soon be moved out of an isolation room, according to her brothers.
About three weeks ago, Nash said the first word since her attack, “Lisa,” the name of her nurse at the Cleveland Clinic.

Detroit police said Leola Brock-Reese wasn't home at the time of the burglary, but her 57-year-old neighbor was and saw men breaking into the home through her window.
When the thieves noticed the woman watching them, one of them fired a shot into the woman's living room. The bullet shattered the living room window, but barely grazed her skin.
Police said it was the underwire in her bra that deflected the bullet.
"Well I was thinking that I should buy more underwire bras," joked robbery victim and homeowner Brock-Reese.
"A miracle bra, yes. That's what saved her life," said Rochelle Wicks, another neighbor.
The woman's daughter, who is also a Detroit police officer, said her mother's minor injuries are from the broken glass.
The thieves did take several items from the house. The gunmen fled in a burgundy Dodge Neon.
Anthonys Tell TV Show They Stand By Casey
ORLANDO, Fla. -- The grandparents of slain Florida toddler Caylee Anthony told a national audience Wednesday they support their daughter, calling her a great mother who could not have harmed the child.
The Anthonys were told it doesn't look good for Casey. With all the evidence, including the duct tape over Caylee's mouth and topped with a heart sticker.
They were asked whether they would want punishment for Caylee's killer, even if it's Casey. "Again, we want the truth, but again, we have to wait for everything to come out at trial," replied Cindy.
Prosecutors said last week they will seek the death penalty if Casey is convicted. Her trial has been tentatively set for October.
The grandparents said it was unlikely that Casey Anthony will accept any sort of plea deal. They said Casey would not admit to something she did not do.
Even though George Anthony told investigators that Casey had stolen money from her daughter Caylee's piggy bank, he defended Casey during the interview.
"I don't think it's possible for my daughter to hurt anyone. And she wouldn't definitely hurt her own child. My gosh, I've seen the love every single day that she had for her," George Anthony said.
The child's remains were found in woods in Orlando in December, six months after she disappeared. Casey Anthony claimed that Caylee was kidnapped and has pleaded not guilty.
Cindy Anthony said that her daughter didn't tell authorities when the child disappeared in June because she was afraid. "I think the truth will come out at trial," said Cindy Anthony. George Anthony also talked Wednesday about his emotional difficulties since Caylee's body was found.
In January, Anthony was admitted to a Florida hospital after he was reported missing and found in a hotel. Authorities said he had sent despondent text messages to family members.
"There's only so much a person can take," he said.
As her parents try to clean up their image with another national interview, Cindy made a startling new claim. Eyewitness News has learned that she's expected to reveal later, that George wasn't the only one in the family who became suicidal. Cindy Anthony also wanted to end her life, but she says Casey talked her out of it after her first arrest.

OPRAH CANCELS INTERVIEW WITH ANTHONYS
Eyewitness News has learned that Oprah Winfrey's planned interview with George and Cindy Anthony has been cancelled. The couple was scheduled to be on the show this May.
"Based on the Anthonys' decision to appear on other programs, we have decided not to move forward with their interview on 'The Oprah Winfrey Show' at this time," the show said in a statement released to Eyewitness News on Tuesday afternoon.
HEARING RESCHEDULED
A hearing in the case against Casey Anthony was cancelled according to an email from the Ninth Circuit Judicial Court sent to Eyewitness News on Wednesday morning. The hearing, scheduled for May 7, has been rescheduled for 10:00am on Thursday, May 28.
Judge Stan Strickland is expected to preside over the hearing, which will deal with the "Emergency Motion for Protective Order" (?) that was filed on March 11, 2009 by Jose Baez.
LEGAL ANALYST REVIEWS BAEZ MOTION FOR CELL RECORDS
There are no secrets in the case against Casey Anthony. If Casey Anthony's lawyer, Jose Baez, wanted to keep secret his attempt to get phone records from key people in the case, WFTV's legal expert says he went about it the wrong way.
SHEAFFER INTERVIEW: Analysis Of Baez Motion
There will be at least one hearing because at least two of the 12 witnesses Baez wants to track through unlimited cell phone records are fighting it and most of the others probably will. Meter reader Roy Kronk and Casey's friend Amy Huizenga say Baez wants way too much.
Baez wants unlimited cell phone records for 12 prosecution witnesses. Two of them, Kronk and Huizenga, are fighting it as an invasion of privacy. "Let's use a scalpel to get at the problem and not a meat cleaver to get at the problem," said Kronk's attorney, David Evans (full interview).
Defense attorney Jose Baez tried to keep his strategy secret, but after Circuit Judge Stan Strickland refused to meet secretly to discuss sending secret subpoenas to witnesses, WFTV legal analyst Bill Sheaffer said Baez filed an unnecessary court motion that will bring unwanted attention. ah, now I see...
"Asking the court's permission to do something you have permission to do to begin with," Sheaffer explained (watch interview).
Sheaffer said Baez could've identified the witnesses' cell phone providers during depositions and then subpoenaed the companies' records directly. Instead, he's asked the judge's permission.
"That will force Baez to tell the court what relevance these phone records may have to the defense," Sheaffer explained.
That includes if he's asked for more witnesses' records than he really wants as a way to try to cover his tracks. Baez is also asking for the unlimited, detailed cell phone records for Casey's parents and her brother. Her parents' lawyer says they'll hand them over, but they have no idea why Casey would want them.

Cindy and George, who did not have much to offer up at their recent depositions in the civil case regarding Zenaida Gonzalez, except for attempts to take control of the situation and gum chewing, now can not wait to talk, and talk and talk.
After weeks of silence and no media whoring, George and Cindy are ready to talk, yet again, in front of cameras and on their terms. Oprah, however, put the brakes on her exclusive interview ~ and perhaps an attempt by the Anthony's to taint the potential jury pool with "their" version of what happened and "their" attacks on law enforcement,~ after Winfrey's discovery that the Anthony's have arranged multiple interviews in the upcoming days even before the taping of her exclusive interview. You go, Oprah!
Here is the first installment of the Anthony's interview that aired on Wednesday morning on CBS's The Early Morning Show. Some other taped segments will air on Thursday morning as well.
Brad Conway, the Anthony's attorney, interjects early in the interview when Cindy is asked about "the smell of death in the car" during the 911 phone calls. Cindy is not allowed to answer. Brad also brings up the subject of "so much pre-trial publicity and how it is going to affect the outcome of the trial". My question to that would be, "Why all the interviews now?" Doing a little spin of your own? A little "deposition flip out" damage control?
Absent from the interview are Cindy's obnoxious gum chewing and water bottle. The now soft spoken Cindy is enough to make anyone nauseous, and George comes off like a whipped puppy. Talk about Jeckle and Hyde. What a contrast from her "you bastard" and "don't tell me I can't pray" screaming fit from just a few days ago. I can't decide which one I prefer, hmm, neither?
And for a little Cindy trivia:
During the almost 9 minute interview itself, in Cindy's responses, she said "you know" a total of 28 times and stated "um" 4 times. That, in comparison to George's use of 2"you know's" and no "um's". A fun fact for those I know that keep up with this for kicks..
